Hello Everyone,
For the past few weeks we have been studying together the chapter שנים אוחזין. This chapter deals with disputes between two parties regarding the ownership of an object which they both claim to be exclusively theirs. The Gemarah presents several examples of such disputes and the various proposals for resolving these disputes.
The Gemarah that we studied seems rather abstract. Can there really be, in the real world, something to which two people have a claim?
Two years ago a baby was born in the Asuta hospital in Israel via IVF. Tragically and inexcusably a fertilized egg was implanted into the wrong mother. Two women then claimed the baby; the genetic mother and the woman who carried the baby to term.
So this evening we will see a survey essay written on this case and we will see how the very learned author thinks the case ought to be resolved.
