Hello Everyone,
In today’s session we will see several important rules of the Halacha’s system of law. One such rule is אם כן מה כח בית דין יפה which I would translate as “If this is so (that a court’s verdict can be reversed) by what measure does the court have authority?” This concept is a very important one in understanding the position of the court in Jewish society. Another important idea is דברי הרב ודברי התלמיד -מי שומעים? When one needs to choose between the words of the student and the words of the teacher to whom does one pay attention? This principle is the basis for the one great exception to the rule of agency. When someone instructs an agent to commit a crime the agent is liable. An agent cannot place the blame on the person who instructed him. As the Gemara says, אין שליח לדבר עבירה.
